1. Purpose and acceptance
These Terms of Use (the 'Terms') govern access to and use of the Pangée mobile application (the 'App'), published by Staivium (the 'Publisher'). By installing or using the App, you acknowledge that you have read and accept these Terms without reservation. If you do not accept them, you must refrain from using the App.
2. Definitions
'the App' means the Pangée application; 'the Publisher' means Staivium; 'the User' or 'you' means any person using the App; 'the Data' means the public geographic, geological and hydrogeological information displayed through the App.
3. Eligibility
Use of the App requires the legal capacity to enter into a contract. A minor may use the App only under the responsibility and with the consent of their legal guardian, who is deemed to accept these Terms.
4. Description of the service
Pangée is a map-consultation app intended for professional field use (hydrogeology, environment). It lets you locate yourself, navigate a map, enable thematic layers from public data and display an information sheet at the point consulted. The App allows no data entry, modification or storage by the User.
5. Free of charge
The App is provided free of charge and contains no advertising, in-app purchases or subscriptions. Any future change to this model would be reflected in an update to these Terms.
6. Licence to use
The Publisher grants the User a personal, non-exclusive, non-transferable and revocable licence to use the App, for use consistent with its purpose and with these Terms. This licence confers no ownership right in the App or its components.
7. Prohibited use
The User agrees not to, in particular: use the App for unlawful purposes or contrary to public order; decompile, disassemble or attempt to extract its source code, except as permitted by law; disrupt or attempt to disrupt the operation of the App or of the third-party services it queries; send automated, bulk or abusive requests; extract or reuse the Data on a large scale outside the applicable licences; resell or redistribute access to the App; or infringe the rights of third parties.
8. Availability
The App relies on services and data provided by third parties (in particular IGN, BRGM, Géorisques, Hub'Eau). The Publisher does not warrant that the App or those services will be available, uninterrupted or error-free, and reserves the right to modify, suspend or discontinue them, in whole or in part, without notice.
9. Third-party data and services
The Data displayed comes from third-party public producers, remains their property and is reused under their respective licences (see 'Credits & sources'). The User agrees to comply with those licences. The Publisher is not responsible for the content, accuracy or availability of data and services provided by those third parties.
10. Data accuracy — essential warning
The Data is provided for information only, with no warranty of accuracy, completeness, timeliness or fitness for a particular purpose. It cannot replace a field survey, a professional measurement, an on-site reading or expert advice. No safety, regulatory, contractual or engineering decision should be based solely on the information displayed by the App. Any use of the Data is made at the sole discretion and responsibility of the User, as an informed professional.
11. No warranty
The App is provided 'as is' and 'as available', without warranty of any kind, express or implied, including as to merchantability or fitness for a particular purpose, to the fullest extent permitted by applicable law.
12. Limitation of liability
To the extent permitted by law, the Publisher shall not be liable for any direct or indirect damage, loss of data, loss of business or other harm arising from the use of, or inability to use, the App, nor for decisions made on the basis of the information displayed. You use the App at your own risk. These limitations do not apply to liabilities that cannot be excluded or limited under applicable law.
13. Indemnification
The User agrees to indemnify the Publisher against any third-party claim, action or demand arising from use of the App that does not comply with these Terms or with applicable law.
14. Intellectual property
The App and its components (interface, source code, visual identity) remain the exclusive property of the Publisher and are protected by copyright; the name 'Pangée' identifies the App. The Data remains the property of its respective producers. Nothing in these Terms transfers any intellectual-property right.
15. Personal data
The processing of your personal data is described in the Privacy Policy, accessible from the App and online, which forms an integral part of these Terms.
16. Suspension and termination
The User may stop using the App at any time, in particular by uninstalling it. The Publisher may restrict or suspend access to the App, in particular in the event of abusive, unlawful use or use contrary to these Terms.
17. Changes to the service and to the Terms
The Publisher may evolve the App and amend these Terms at any time. The applicable version is the one published in the App at the time of your use, whose effective date appears at the top of the document. Continued use after a change constitutes acceptance.
18. Governing law and jurisdiction
These Terms are governed by French law. In the event of a dispute, the parties will seek an amicable solution; failing that, the French courts shall have jurisdiction.
19. Severability, entire agreement and no waiver
If any provision of these Terms is held void or unenforceable, the remaining provisions shall remain in full effect. These Terms, together with the Privacy Policy, constitute the entire agreement between the User and the Publisher. The Publisher's failure to enforce any provision shall not constitute a waiver of it.
20. Language
The French version of these Terms prevails. Any translation is provided for your convenience; in the event of any discrepancy, the French version prevails.
